And what ticks people off is his claims of wanting to "move on from Live".

He wanted to move on from the 3 members of LIVE who he no longer got along with, never from the LIVE music.

That's not what he said. He said he wanted to move on from Live, and focus on his solo work and new music.

I'm on the fence for right now. But as soon as the new lead singer is revealed and they play a show Ed must stop using the Live moniker. Additionally, he should stop playing Live's songs once this occurs.

They could ruin him. wink.gif

Aitkens...you are letting the facts cloud your ability to unconditionally praise and love Ed. Please stop.

He can still use the moniker and perform the songs since he did have a hand in writing every song that LIVE has ever released.

But does he own the rights to the songs? Paul McCartney couldn't tour as a former member of the Beatles singing Beatles songs, he had to do his own thing.

I believe he does. Chad Taylor has stated that Ed is allowed to perform the songs in concert.

Of course he is allowed to perform them in concert. I have the right to perfrom them in concert. not that anyone would want to hear that. Local cover bands have the right to perform them in concert.

What Ed does not have the right to do is perform them in his Eddie K acoustic shows and record the performances and sell them on his website and not pay royalties to the royalty company that owns the songs.

And Ed does not have the right to claim that he is currently with Live. Live is an entity and it is owned by CCP. They have a right to control it's likeness and image and intellectual property. Ed has been removed. Ed can get paid royalties pursuant to his contractual rights under the existing publishing contracts for the old songs. But he does not have the right to the Live name. His references to his association with Live should be carefully worded so as to not mislead the public and utlize the Live brand for his gain or to the detriment of Live. Any such use of the name Live that is misleading or use of the likeness and image of Live, without the permission of Live, is actionable. Any profits off of performances or use or reproductions of Live songs without the payment of royalties to the publishing company is actionable. Stealing the copyrights or the image of Live and using it for profit is no different than stealing Chad's car from his driveway.

So Nick, in your mind it's not fine for CCP to imply that Ed is still in Live (even though that's not what they're doing), you believe that because they are not shouting it from the roof tops constantly that it is misleading the casual fan who isn't in the know.
But you think it's fine that Ed can imply that he is still in Live to the casual fan who is not in the know? To someone who hasn't been paying attention, there is nothing about that poster that suggests Ed is finished with Live as an active member. Double standards at play again but hey so long as its helping Ed's wallet out you'll sleep soundly at night.

the deception is there according to the little green with envy one......I think it's been proven here and else where that there is no deception.

ed can play the songs, he's entitled to legally. there is no debate on this. He cannot say he's in Live anymore. If he chooses to come back and work in total partnership wth CC&P, they'll be open to it.

Which would be ideal for many, at least on a part time basis.
