QUOTE(Desiree @ Jan 27 2011, 9:40 pm) *
No argument that they CAN use it however they see fit. My concern is that I didn't want to receive the information I began to get, and no one asked me if I wanted to. I signed up for something specific and was then receiving emails I didn't want on something else entirely.

Again, even when I tried to remove myself, I couldn't. It told me I had "sucessfully unsubscribed" (or some variation there of - it was a confirmation) and yet the emails I didn't' want kept rolling in.

I also think swearing at someone is a completely inappropriate way to get their message across. What you just said, which was friendly and polite even though the message is clearly received, could have worked just as well. There's never a reason to resort to four letter words - especially when you people have put energy into you and your successes.

Thanks for taking the time to respond amicably, though. Much appreciated.

I think Live news should include whatever is related to members of the band that they want to share. I think there is less of a TGF argument when you consider that Ed Kowalczyk was promoted in those messages too regarding his solo career. Is a few messages per year from the guys that much of a nuisance? If opt out doesn't work then I guess you should be miffed, though probably not worth it. It was totally lame how Chad or whoever reacted though.

QUOTE(dangum @ Jan 27 2011, 10:11 pm) *

Ignorance is no excuse for spamming people. I think you'll find that the penalties for sending out unsolicited emails are quite severe. Many corporations (Virgin for example) have been fined recently when their 'unsubscribe' functionality didn't work.

If you run a mailing list, then it's your responsibility to ensure that emails are only sent to those who request them and you must take action when a person opts out.

I think the issue here is if CCP is really "running a mailing list". My thoughts are that they pay for a service from companyX that holds the database, the code, the software and that CCP are the end users (of which they probably pay a fee). I doubt CCP did any coding or database work. So IMO, the unsubscribe function not performing is ultimately the responsibility of the service provider. However, as a fan, we can only communicate to CCP. It's their responsibility to take the issue to the service provider.

I think though in this case, the actual controls for mailing list belong to a third party. I could be wrong, though. If it is controlled directly, I imagine they were still getting together how to use it. Ed's mailing list did the same thing to me early on.

I believe the fines come into play for e-mailing people who have never subscribed, not former subscribers. I could be wrong on that though too, just expressing it as I understand it. That is certainly worth a stiff penalty.

My main point though is that I don't think this is as annoying as a lot of people make it out to be if you use a decent e-mail service. I agree that the mailing list operator needs to be careful, and I certainly am.

Seriously, one fucking e-mail. Delete and un-subscribe.

So, stop whining about how they are not allowed to mail you. They are 3/4 of what LIVE was and so there is a pretty big chance you'll enjoy their music.

You really are extremely pathetic if you go crying on their Facebook like that. Get a life.

I agree, this girl is annoying. "How dare they.....", "I'm hurt!" Unbelievable. Can someone tell me how to "opt out" of her tedious posts? Oh, and by the way, I'm not convinced she's actually had to unsubscribe 3 times either. Why should we believe her. I smell a seminar poster (hired by EddieK of course eyebrow.gif )

I guess she got hurt by their response, but jeez it's just some email or two that happened how long ago last year. Why keep bringing this up here now. Really just get over it.

The "technical" issues for the unsubscribe are ultimately a separate point but absolutely belong to the 3rd party service provider if something isn't working properly. knowingly spamming somebody who is trying to opt out is when the potential foul play comes in to it but I highly doubt this was the case and I would guess that if the issue was known, the service provider would have done their due diligence to resolve the issue in a reasonable amount of time.

As far as using their list for other avenues, it is preposterous to suggest that TGF isn't Live related. Most fans of any band would want to hear about solo/side projects and other bands that members or former members are involved in, and unless otherwise stated, C,C & P have every right to network utilizing their fan-list to promote a new endeavor. This is the value of owning a and retaining mailing list! Are they just supposed to simply sever all ties with Live fans and start from zero? Ridiculous. Her initial reaction was not about the unsubscribe but rather the fact that they had the nerve to send their fans content on TGF. Really??? Sorry, that just isn't the way it works.

People in marketing/business channels leave jobs or situations all the time and when they have the right to do so, they will take their networking contacts and mailing lists with them to their next opportunity. This situation doesn't even begin to embark on that level.
