A settlement in my eyes is an admission of guilt .so if he settled...it is like he is admitting that he wronged them.....understand Nick! just my opinion

It's an admission of guilt to me! Too bad they couldn't make Ed pay and do community service too! lol.gif But it's not a criminal case.....

Not necessarily. Sometimes there are settlements because the possibility of high legal fees and losing (you can never tell with a jury) that defendants feel that is in their best interets, especially if they already wealthy and can afford it.

QUOTE(SJN1279 @ Jun 14 2010, 7:59 pm) *

Exactly why am I mentally ill?

Delusional disorder is a psychiatric diagnosis denoting a psychotic mental disorder that is characterized by holding one or more non-bizarre delusions in the absence of any other significant psychopathology. Non-bizarre delusions are fixed beliefs that are certainly and definitely false, but that could possibly be plausible, for example, someone who thinks he or she is under police surveillance.

Key in this description is the term "FIXED BELIEF" -- you are unwavering in your belief in Ed - to an degree that is UNHEALTHY. you come across as BRAINWASHED.. someone who is incapable of thinking for themselves.. in your defenses of Ed, you dont come across as GALANT, you come off as THIS NUT JOB.

Yeah it's a shame. I'd love to see Ed in an orange jumpsuit picking up trash. I'm sure he would rock that look! lol.gif

A settlement is a way to avoid 5 years of court costs, not always an admission of guilt. Once you get to a jury anything can happen too. Our court system is very flawed.

QUOTE(livefan86 @ Jun 14 2010, 6:22 pm) *

"29. In 2005, Kowalczyk presented the Plaintiffs with an ultimatum: Kowalczyk would quit the group LIVE unless Plaintiffs agreed to give Kowalczyk (or Kowalczyk’s designee) sole writing credit for all songs embodied on hture LIVE albums. Although the Plaintiffs were shocked by this ultimatum, they acquiesced to Kowalczyk’s demand, both out of respect for their decades-long friendship with Kowalczyk, and because the Plaintiffs placed a high value on keeping the classic lineup of LIVE together, after the many years of hard work they had put into building up the band’s following and reputation."

This is nothing new, in the sense that this is a reiteration of the unproven claims made by the others. I note that it is not in the "complaint" section - as noted by Funkyredcaboose. I wonder why.
QUOTE(thefunkyredcaboose @ Jun 14 2010, 6:54 pm) *

What is interesting is that the described 2005 incident of Ed threatening to leave isn't under the "complaint" section of the document. It makes perfect sense given all that transpired after too.

Now this is real meat.

QUOTE(OutToDry @ Jun 14 2010, 6:29 pm) *

Yeah, they are suing for punitive damages and a full accounting of 20 years from their accountant and want to recoup all fringes. There are 5 counts of fraud.
a) Breach of Fiduciary Duty (Levin & DLBM)
b) Aiding and Abetting Breach of Fiduciary Duty (Ed & FVI)
c) Breach of Contract (Ed)
d) Tortious Interference with Contract (Levin, DLBM & FVI)
e) Equitable Accounting (Levin & DLBM)
and they want a jury trial
It appears for the 5 counts (total of 3.6mil plus punitive for the 5th count)

I almost wish I'd gone into law like my parents wanted me to.

My crystal ball says it will be settled, too, because it looks like Ed is guilty as hell. All of this comes down to the specific language in those agreements, but honestly, in your gut you know the guy is guilty as balls. The fact that he approached them with that ultimatum, which is inconsequential to this legal argument but relevant to our arguments here, is outrageously fucked up. This guy is a giant egomaniac whose pure and honest message is now known to be a complete crock of shit. Nick can sidestep having to come out and say this looks awful for Ed, but he knows it deep down. Delusions are hard to break. I believe I'm the third or fourth person in this thread alone to mention delusion when referring to you, Nick. Starting to see a pattern like we discussed the other night?

I know we also discussed something related to your past issues too.

Seeing one side of a complaint and making a verdict is short-sided and the biggest problem with our court system.

Ed's been actually working since the break-up, the rest have not.
