The issue comes from profiting off the song. An artist can essentially perform any song they want as a cover in concert, as they are not profiting directly from that song being included in the concert. However, were they to record the song and sell it, either as a studio recording or as a concert performance, they would then need to abide by the RIAA regulations.

The way it should work is that the venue pays certain fees to organizations such as ASCAP that cover any copyrighted music that is performed there. Any of the venues that Live is playing at should have all of this covered. Back in the day, I used to play in a couple of bands that did several covers, and that was always something to try to be aware of.

Daughtry's fans consist of 16 year old girls and 40 year old mums. Nothing in between. I wouldn't expect audible recordings from any Daughtry show. Also, tickets to the Revolution performance was very limited. Only 200 tickets were available, with most being auctioned on eBay for a charity.
