Ed's original intention was to release a solo album and then return to Live. However, once Ed left, bad feeling between the band become public and the hiatus turned permanent.

I know you guys don't really keep up on ed but yeah, he did do some freebies but he also sold out quite a bit of shows already. That first time out and now on this i alone tour as well.

Holding all the legalities aside, I think it should be as simple as this. If one guy leaves or is fired, and three-fourths of the band stay together, I think the three-fourths should get to use the name. If I recall, ownership of the Live entity was split 4 ways.

As far as Ed goes, calling himself "Ed of Live" should be out, as he is no longer "of Live". I have no problem with "Ed Formerly of Live", because that is true. He was a HUGE part of the band for many years.

I understand where he is coming from, but Ed kind of needs to move on. Naming your album "Alive" and your tour the "I Alone" tour is really a hack move and screams of desperation. You are embarking on a solo career, you should either stand or fall on your own.

I think Ed Kowalczyk (performing +Live+ and solo songs) would be the way to go. Ed definitely wants people to know he'll be playing Live's old hits. He's trying to make money, and wants people to know that its a novelty act, and it will be nostalgic.

It's not "Ed and his songs". Not literally, not technically and not legally.

Ed didn't play the bass, lead or drums. Ed did not write those parts. Ed did not compose and arrange the songs. Ed wrote most of the lyrics, but not all and most, but not all, songs started with a basic melody that Ed wrote.

The reason they can use the name is that it is a majority rule. Since 3/4 of them are still around and since Ed voluntarily left, they have legal right to the name. It'd be much more problematic if they split 2 and 2, but since they split 3 and 1, it's simple.

You think Ed should have the right to walk away, and the other guys just be fucked out of the namesake? How in your whacky little head is that OK?

I think you Ed trolls forget that ED walked away from the band. He was not kicked out. He wasn't replaced. He left and the guys wanting to forge ahead found someone new.

I thought Ed was fired as well. Sort of a back and forth that created the split, not just Ed.

Based on your logic, could you really use the majority of band members as the basis for keeping a name? What if ECCP also had two trumpet players, railo, adam, and a couple other players that contributed to the new recordings for many years. What if ECCP decided to dump the excess and go back to the original four. Could the other 6 hypothetical ancillary players keep the name Live, since they outnumber the original members 6 to 4? Or should we also consider the value and amount that was contributed to the creation of final product of the music, or contributed to the fame/success? What if one member wrote 6 huge album hits and the other guys wrote 300 mediocre songs that didn't make the albums? Who would be considered a greater part of the band? There was contribution from all members Live, but creating the chords and lyrics and vocal melody might be more substantial than the other instrumental parts, as great and vital as those parts are. The industry looks to the singer/songwriter as the quintessential entity. Live4life was specifying the songs that made Live famous, which is mainly the Throwing Copper hits that Ed brought to the table for the band. That's where people argue for Ed, when saying he should be able to use the name Live.

I think they should all be able to touch on the name Live since basically defines their life.

I would assume so.
He is a founding member so i don't understand how they can use it but he can't.
It just doesn't make sense. They are all just so butthurt. Ed moved on and things are going great for him. I think it was the best thing he ever did.
