I'm pretty sure the law applies whether you try to make money off of the thing or not. I don't think Coke is going to be suing Live anytime soon, but I'm pretty sure they could if they wanted to - not necessarily for $ damages, but at least a cease and desist... US trademark laws are no joke.

I also thought it ironic. I knew the boys of Live didn't create it (I'd see it before regarding the Italian band) but I thought it pretty amusing that it was on their page. I didn't notice if they put it there or someone else did, though.

I'm not 100% sure, but it looks like they don't want Ed to reference "Live" in his promotion at all.
ie. he can't even say "Ed Kowalczyk former Live frontman".

What's also interesting is that according to the document Ed was kicked out of Live in late 2009. This was early on in the hiatus period.

Well considering all the stuff about the money stealing and such seemed to come out in late 2009 (didn't it?) then that doesn't surprise me with the timing. As for not being able to use the Live name at all ... as much as I want to see the slimy little prick suffer for the shit he's done I don't see any problem with saying "former singer of Live", I mean it is undeniably true. I guess their reasoning is that with people skimming ads they'll just see "Ed Kowalczyk" and "Live" and not fill in the blanks, Nick should be able to sympathise with that since he's admitted on more than one to skimming over so much on the board (admittedly it's the stuff he doesn't have an answer for smile.gif) but if people do the same then in the public's eye perhaps there is no difference between "Former" "of" "Live's" etc.... it's just the association by the 2 names which when Live is about to get itself back up off the ground again is an important thing.

this is my post on page 23. In the suit it says on pt.24 ed was removed from the band as a member in late 2009 (band Corporation). So he did leave them for solo (announced hiatus), then in october the split due to the first lawsuit claims. He's not been an official member since about Nov 2009.

But you know what, guys? During the last 2 years he was billed as "of Live", "from Live" etc so many times that even a casual listener would probably know by now what kind of Kowalczyk that is even without the word "Live" near his surname.

CLever and calculated. This suit is to protect the band, in this case Ed and others from infringing on the name and mark. It has to be done.
