I think if that logo is used on a shirt, a poster or anything else it would be. They're not selling anything by displaying it.

And by the way, that's a logo or mark that was used by an old Italian punk rock band CCCP - Fedeli alla linea. When they used that logo to promote the band, Coke did come calling.
