Why are we even talking about Ed and his solo career? He hasn't had a solo career. All it has been is "Live's" or "of Live" and a Live dominated setlist.

Even for his radio interviews he will play Grace, then two or three Live songs.

Ed hasn't had a solo career. In fact, Ed has been Live 2.0

The original Live is still just Live.

I haven't read the suit, but wouldn't dilution mean someone using the trademark without consent? A lawsuit like this isn't about quality.

Could be wrong, but that would be mighty stupid. I generally know more about copyright suits than trademark stuff though.

Dilution is separate. The owner of a mark can bring an action against any use of that mark that dilutes the distinctive quality of that mark, either through "blurring" or "tarnishment" of that mark.

Ah okay, thanks for the clarification. Wouldn't that still have more to do with distinctiveness than song/performance quality though? I think those two things are being confused here.

I think you and I are kind of saying the same thing.

Oh, yeah, not to do with the performances just the "damage" or dilution to the trademark.

If that were the case Live should sue itself for SFBM

He will bill himself as "that bald guy who sang Lightning Crashes"

Anyone here think that this billing would draw more fans than either LIVE or Ed Kowalczyk (or any combo of his billings)? Combined?

If I polled my friends, it wouldnt even be close. sad.gif

Just give me some freakin music and keep your dirty laundry (and politics) indoors where it belongs!

But what if they won? Does that mean that they lost?

It's funny because I had nearly the same thought wayyyy back on page two.

QUOTE(Badman @ Jul 17 2012, 5:11 pm) *

He could start another band but it wouldn't be easy and you can bet his past fans would be begging him to play other stuff. He doesn't have a name following at all. If he called his solo band "lightning crashes bald guy" he would have more recognition.

Its just funny, i dont care who wrote it where.

And its sad because it would likely out-draw anything that Live is currently doing.

Live can bill themselves that way too, the band that did Lightning Crashes. Just depends on which act you want to see, or both.

Speaking of silly lawsuits, today's Andy Griffith synopsis:

Otis the Drunk slips in jail and a lawyer convinces him to sue the county .
