Pennsylvania State Police are investigating a report of a more than $3.82 million theft from United Fiber & Data, a telecommunications startup in York that’s connected to members of the multi-platinum-selling rock band Live.

Law enforcement released few details but stated that the case is “still under active investigation with other agencies involved.” Police listed the time and date of the incident in a report as Jan. 1, 2017, to Nov. 6, 2020.

In an email, Cpl. Brent Miller, a spokesperson for the Pennsylvania State Police, wrote that personnel from Troop J visited the headquarters of United Fiber & Data at 210 York St., near PeoplesBank Park, on “multiple occasions.” The building has a sign on the front that reads “Think Loud” in black letters.

Kyle King, a spokesperson for the York County District Attorney’s Office, declined to comment. A spokesperson for the U.S. Attorney’s Office in Harrisburg, Dawn Clark, said she could neither confirm nor deny the existence of any investigation or charges, per U.S. Department of Justice policy.

Andrew Paxton, president and general counsel of United Fiber & Data, could not be reached for comment.

The founder and former CEO of United Fiber & Data, Bill Hynes, directed questions to his attorney, Heidi Eakin, but said in a text message that he has "never been contacted by anyone regarding anything." She could not be reached for comment.

In a lawsuit, United Fiber & Data, the Powder Mill Foundation and Louis Appell III, the son of Louis Appell Jr., the late businessman, philanthropist and civic leader in York, allege that Hynes, in concert with others, engaged in a years-long “pattern of unlawful conduct” including theft, fraud and self-dealing to “fund a lifestyle that he otherwise could not afford.”
Hynes has denied the allegations.

Gov. Tom Corbett’s administration awarded a total of $7 million from the Redevelopment Assistance Capital Program to the 210 York St. project, which included renovating the 53,000-square-foot building. The state sent a check in 2018 for $3.38 million to reimburse for construction costs, according to the Office of the Budget.

The lawsuit claims, among other things, that Hynes, a felon, engaged in a “straightforward and blatant act of theft” of that money.

Hynes, 49, of York, is free on $50,000 bail while he awaits trial on charges of burglary, forgery, tampering with public records and related offenses. He’s accused of assaulting and stalking a former employee, breaking into her home and taking out a fraudulent second mortgage on the house.

Jason Confair, an attorney who represents Chad Taylor and Patrick Dahlheimer, the lead guitarist and bassist of Live, respectively, and their business interests, declined to comment.

But Confair stated that police have not approached his clients in any manner regarding the investigation.

Taylor is also named as a defendant in the lawsuit. The complaint asserts that he breached his fiduciary duties and took part in self-dealing.

United Fiber & Data built a 340-mile fiber-optic line connecting New York City to Ashburn, Virginia, in the suburbs of Washington, D.C. The startup touted that it would create more than 300 jobs and generate in excess of $2 billion in state tax revenue in 30 years in Pennsylvania — though the business seems to have not yet lived up to its own hype.
