I am not a musician. But I am a business man. I am a part of a successful company, we've been in business for over 12 years. When someone decides they want to leave, we have a decision to make. We 1) just let them leave, or 2) ask them to please reconsider. If we ask them to reconsider, they typically have terms that need to be met inorder for them to stay around. Either we counter-offer, or they present the terms, and we decide if its worth the risk.

Maybe we're talking about a real key player in what we provide to our clients. And said employee comes to us and says that they've been presented with an amazing new opportunity, but that they'll consider staying around if we do A, B, and C for them. We have a big decision to make at that point.

Should be no different in the music business.

And when those terms are not met I'm sure one party will be going after the other.

I agree if my own brother gave me that ultimatum I would be shocked, it would not be acceptable to me at all - 20yrs of friendship down the drain for a writing credit and $$$ I was sad that Live ended; I'm devastated that this is how it panned out.

Edward Joel Kowalzcyk; you have dissapointed your longest serving fans, you have lost your friends respect and worse than all of that the greed and selfishness you railed so hard against in your youth is what you have now become.

'oh, Edward in a robe of truth
my emptiness has built your altar
and I've worshipped myself in you forever
until now'

Redemption is yours to win Ed but it's a long and winding road brother.

You're looking at it from the Nick point of view, as business. There is a difference between the music business and a band. A band is a group of artists, sometimes friends come band members, other times band members come friends. The dynamics within the band are not and SHOULD NOT be the same as business dealings. They are also different to the music business which is there to just enable a band to reach wider audiences and such.

Like FRC said, you've obviously never been in a band .. he is in one, I have been in one, you can't compare it to a business or company.

So maybe in Ed's mind, he already had his bags packed and loaded in the car along with his new 'creative' direction. And the other guys agreed to go along for the ride on Ed's coat-tails. No one forced them to agree to the terms. It was a risk they agreed to be a part of.

Now the enforcement of said terms is separate from this. If a party was wronged, I expect it to be made right. Does that mean that there was ill intent? Not necessarily.

Absolutely. And one would expect any wrongs to be made right.

Ed paid himself a million dollars behind their back. He must have acknowledged it somehow because he did pay them $75,000. Now he owes them another $225,000. I wouldn't say doing that behind their back has good intent.

And hopefully that'll be the case and Ed pays through the nose for it.

There are plenty of creative dynamics in a company/business as well. Band members dont owe their lives to one another. Nor should they define themselves by the band in which they are a member. Dynamics in a band are whatever you make them out to be. I promise you, when you're dealing with on that's had the success of Live, there is a LOT of business involved.

Well not one of us knows the boys or Eds motive especially at the time circa '05 - I was merely responding in agreement with pokey regarding the moral ethics involved here rather than the business or contractual side of things.

What it boils down to is Ed wanted control and he was willing to present an ultimatum of breakup to friends of 20yrs to get it...I don't care who you are that alone is wrong.
Now TGF signed it; maybe that was their mistake but as I said before no one can tell motives but what is in ones mind is often clearly deciphered by others in view of their actions...

Maybe Ed's legal advice at the time said that the million dollars was 100% his. We really have no idea how all of this went down.
