QUOTE(FishOutaWater @ Aug 25 2012, 2:16 pm) *

Litigants don't give depositions to the court. Each parties' lawyer takes depositions of individuals to gather statements under oath that will support the lawyer's briefs. In this case the parties being deposed should include CCPE. The deposition testimony won't be made public. This is not testimony in open court. What this means is that the discovery stage of the case is proceeding. That order also addresses the production of documents. This order says that the plaintiffs have priority to take the depositions of the defendants first, and then the defendants may depose the plaintiffs. The depositions of the defendants shall occur during October and the depositions of the plaintiffs shall occur during November.

A settlement is how the majority of lawsuits end. It would be best to end the nonsense and move on.

Surely you'd think if Ed "never did anything dishonest" as he claims he would fight tooth and nail to the bitter end for his honor. CCP accepting a settlement would just mean they're happy to get some kind of compensation for the hurt and damage, they don't NEED to go the whole way, but if Ed is as innocent as he claims, you'd think he should. But he's not.

How does that make sense? Why can't Ed accept a settlement in some kind of compensation for the trouble? Or why would CCP accept a settlement when the are as innocent as THEY claim?

I just figure that CCP aren't out for blood as much as some people might think. If they see an opportunity to end it but yet still feel they got something for it then they may take it.
CCP may accept a settlement because it might still be a fair amount to them? Ed on the other hand was the one who had the lawsuit thrown at him, I know if I was a totally innocent person and someone wanted to sue me and I knew I was innocent and had the means to prove it (which I assume Ed does, if he's innocent, why would there be any evidence to prove otherwise?) then I would want to fight it and make sure I won against a law suit that tried to sully my name, my reputation and take my money.
If I was innocent the last thing I'd want to do is go "hey I'm innocent, but here have some money anyways for all the trouble you caused me!"

Anyways, that's just the way I see it.

I see what you are saying but I think it is not all that black and white. These guys are all businessmen and that has little to do with innocence. From 'business' point of view, settlement is often preferred over a court ruling. But as we've seen that emotions take over now and then, I don't dare to speculate.

I'm not really speculating either, I guess I just am seeing it more from my point of view if I was in Ed's shoes and if Ed truly was innocent, there is no way that I'd want to settle for anything less than clearing my name and not handing money over to people who falsely accuse me. I guess I just see doing that as some kind of act of admission of guilt on his part.

The legal system usually takes many years and a lot of money before you reach a conclusion reached by 12 usually inexperienced people that can go either either. Settlement is usually the preferred avenue to just end the inconvenience of it all.
